Terms & Conditions
General
All business is conducted in accordance with these conditions of hire, unless otherwise amended in writing by the Company.
Definitions
The "Company" means Pal Rental Ltd trading as Devon Toilet Hire, its subcontractors, agents, successors, assigns or personal representatives.
The "Hirer" means the person, persons or their representative hiring the Equipment from the Company.
The "Equipment" means mobile toilet units, other mobile or static unit facilities and equipment including all fixtures and fittings.
The Site
The hire charges are based on the site is flat, level and provides solid standing with suitable access for the Equipment and associated vehicles.
The Hirer warrants that the Company's vehicles and Equipment will have suitable access free from overhead obstructions including trees and hedges and free from underground services including water pipes, sewer pipes, gas pipes and electrical cables that may be damaged during transport, installation, use or removal.
The Company reserves the right to charge for any damage caused to its vehicles and Equipment due to unsuitable site conditions or access.
The Company reserves the right to charge for delays and additional labour required in connection with delivery, collection, installation or removal. The current rate is £30.00 per hour.
One hour maximum site time is allowed for delivery and collection.
The Company shall not be responsible for any making good, repairs or damage to the site.
The Hirer shall be responsible for providing and connecting any required mains services unless otherwise agreed in writing. This includes topping up water for trailers and switching the valve over for gas bottles during the hire period. Please ask if you need to be shown this on delivery of the trailer.
If collection of the Equipment is delayed beyond the agreed collection date for any reason, including restricted access, marquee erection or adverse weather conditions, the Company reserves the right to charge additional hire at 15% per day of the quoted hire charge or the full rental rate if another booking cannot be fulfilled.
Liability
The Company accepts no liability in respect of third-party claims or consequential loss or damage of any kind. The Hirer shall indemnify the Company against such claims except where liability arises from faulty materials, workmanship or negligence of the Company.
The Company accepts no liability for malfunction of the Equipment where the duration of hire or number of users exceeds that stated in the quotation.
Title
The Equipment remains the property of the Company at all times.
The Hirer shall allow reasonable access to the Equipment during the hire period and shall keep the Equipment in their possession and control, free from any legal charge, lien or claim.
Subletting
The Hirer shall not sublet or rehire the Equipment without the Company's prior written consent.
The Equipment
The Hirer shall be responsible for all costs arising from breakdown, wilful damage, negligence, loss or misuse of the Equipment.
The Hirer shall pay the full replacement cost of any Equipment lost, stolen or damaged beyond economic repair and should insure the Equipment accordingly.
The Hirer shall not move the Equipment from the position where it was installed without prior agreement from the Company.
Hire Charges and Payment
Hire, delivery and collection charges are as stated in the quotation.
Bookings are confirmed only upon receipt of a 25% deposit.
Deposits are refundable up to 30 days before the booking start date; after that, they are
nonrefundable.
Full payment must be received no later than ten working days before delivery.
Cancellation Fees
Where cancellation occurs within one month of the delivery date, the full hire charge remains payable.
Acceptance
Acceptance of the Equipment on site by the Hirer shall constitute acceptance in full of these Conditions of Hire.
